Paginate.io Server and Website Management Terms of Service

By using Paginate.io's ("Paginate.io", "our", "us" or "we") website, products and services ("Service", or "Services"), you ("you", "your", "Client" or "Customer") agree to comply with our policies as set forth in these Terms of Service ("Terms of Service", "TOS", or "Agreement"). Ordering services through our website or through an authorized representative constitutes your acceptance and agreement to be bound by these Terms of Service. Paginate.io reserves the right to cancel, suspend, or terminate any service provided with or without a refund or notice or warning for any reason. Paginate.io also reserves the right to change and modify the Terms of Service at any time with or without client notification. It is up to the client to periodically check and familiarize himself or herself with the recent Terms of Service. If any client does not comply with the new Terms of Service modifications, his or her service will be terminated.

Acceptable Use Policy

By ordering our services, you agree to adhere to our Acceptable Use Policy ("AUP"). Failure to do so will result in suspension and possibly termination. Your account may also be reported to FraudRecord.

General Technical Support

Paginate.io technical support is handled through tickets submitted in our Client Area. We generally process tickets in the order in which they are received. Multiple replies to tickets will not ensure that you receive a faster response. We only offer support in English and Filipino, and require that either language be used to communicate with our staff. We do not tolerate profanity or abusive language in any form of contact with us including, but not limited to, emails, live chat, and our ticket system. Such behavior will result in a warning, followed by suspension and/or termination if the warning is not heeded.

Paginate.io support is available for non-critical issues between the hours of 12:00 and 18:00 GMT+8. Critical support for server or network problems is available 24/7.

Uptime Guarantee

Paginate.io guarantees a 99.9% monthly uptime for all website and email hosting services. Should we not meet this uptime guarantee in any given month, we will credit a percentage of your monthly service fees based on the following tiers:

Account credits may not be exchanged for cash. We will only allow one uptime guarantee credit claim per client per month. Service interruptions caused by scheduled and announced maintenance work are exempted from this guarantee. Service interruptions due to natural disasters are exempted from this guarantee. Clients participating in illegal, malicious, or any other activities that violate our Terms of Service will not qualify for uptime guarantee credits. Paginate.io will not provide credits to clients with invalid and/or unverified claims. Statistics provided by external services may not be used to claim credits.

Backups and Data Loss

Although Paginate.io does backup customer accounts daily, we cannot guarantee the integrity of customer data or databases taken at the time of backup. You agree to take full responsibility for files and data transferred to, modified, deleted, and to maintain all appropriate backups of files and data stored on Paginate.io's servers.

Service Payment, Refunds and Cancellation Guidelines

You agree to supply appropriate payment for the services received from Paginate.io, in advance of the time period during which such services are provided. You agree that until and unless you notify Paginate.io of your desire to cancel any or all services received, those services will be billed on a recurring basis. If the client creates a subscription to pay for his or her service(s) with Paginate.io, the client is responsible for canceling that subscription when he or she no longer wants service with Paginate.io. Paginate.io will not be responsible for handling or refunding any transactions that take place after the client has cancelled their service with Paginate.io in the event that the client fails to cancel the related subscription.

Paginate.io uses prorata billing for services that require recurring fees, therefore clients with these services will be charged every 1st of each month regardless of their service activation / signup date.

All payment invoices are generated seven (7) days before payment is due. Failure to pay by the due date will result in suspended and, ultimately, terminated service. Paginate.io reserves the right to terminate your service at any point after your invoice is overdue, and will not be responsible for any data loss due to termination.

Paginate.io provides a 7-day grace period from the time the invoice is due and when it must be paid. Any invoice that is overdue for 7 days and is not paid in full will result in account suspension until the account balance has been paid in full. Invoices are assessed a late fee of 10% when they become 3 days past due. Any account that is overdue for 30 days will be automatically terminated and Paginate.io shall not be responsible for any and all resulting losses.

Paginate.io offers a 7-day money back guarantee for your first payment on your first website management service with us. Refunds must be requested via support ticket in the Client Area after a cancellation request has been submitted. Software licenses, domain registrations, and domain transfers are NON-REFUNDABLE.

Payment Chargebacks and Billing Disputes

Raising a billing dispute with our payment processors or charging back a payment made to Paginate.io will place the client's account in bad standing. We reserve the right to immediately terminate all services without refund in such instances.

Any chargebacks against Paginate.io will incur a PHP5,000 chargeback fee.

Other Disputes

Any threat of legal action against Paginate.io by a client will result in immediate account and service termination without refund.

Indemnification

You shall defend, indemnify, and hold harmless us, our affiliates, parents, subsidiaries, any related companies, licensors and partners, and each of our and their respective employees, officers, directors, agents, contractors, directors, suppliers and representatives from all liabilities, claims, and expenses, including reasonable attorneys' fees, that arise from or relate to your (or any third party using your account or identity in the services) use or misuse of, or access to, the services, content, or otherwise from your user content, violation of these terms of service or of any law, or infringement of any intellectual property or other right of any person or entity. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in asserting any available defenses.

Paginate.io shall not be responsible for any damages your business may suffer. Paginate.io makes no warranties of any kind, expressed or implied for services we provide. Paginate.io disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Paginate.io and its employees.
